1. About Agency Card

Agency Card provides hosted profile pages that allow insurance professionals and organizations to publish contact information, links, calls to action, and other information they choose to share with prospects and customers.

Agency Card is a software provider. Agency Card is not an insurance agency, insurance carrier, broker, producer, or advisor and does not sell, solicit, negotiate, bind, quote, or provide insurance coverage.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Agency Card.

If you use Agency Card on behalf of a company, agency, or other organization, you represent that you have authority to accept these Terms on its behalf.

3. Your Account

You are responsible for maintaining the security of your account and login credentials.

You are responsible for all activity occurring through your account and for keeping your account information accurate.

You may not share access in a way that circumvents account, user, or plan limits.

4. Your Agency Card

Agency Card allows you to publish information such as your:

• Name
• Profile photo
• Agency or company name
• Job title
• Contact information
• Social media profiles
• Website
• Quote links
• Insurance data intake links
• Scheduling links
• Other links and calls to action

Information you publish to your Agency Card is intended to be publicly accessible. Do not publish information you want to keep private.

You are solely responsible for the accuracy, legality, and appropriateness of the information, links, images, and other content you publish through the Service.

5. Insurance and Regulatory Compliance

You are responsible for complying with all laws, licensing requirements, advertising rules, carrier requirements, agency policies, and other regulations applicable to your insurance activities.

Agency Card does not verify that a user is licensed to sell insurance in any particular jurisdiction unless we explicitly state otherwise.

The availability of a feature, button, link type, template, or other functionality does not mean its use is legally or contractually permitted in your situation.

6. Third-Party Links and Services

Your Agency Card may link to services operated by third parties, including quote systems, insurance data intake tools, scheduling platforms, social networks, agency websites, and other services.

Agency Card does not operate or control those third-party services and is not responsible for their availability, security, privacy practices, content, accuracy, or performance.

Your use of a third-party service is governed by your relationship with that provider.

7. Acceptable Use

You may not use Agency Card to:

• Violate any applicable law or regulation.
• Impersonate another person or organization.
• Misrepresent your identity, licensing status, agency affiliation, or professional qualifications.
• Publish fraudulent, deceptive, defamatory, or unlawful content.
• Distribute malware or link to malicious content.
• Attempt to gain unauthorized access to Agency Card or another user's account.
• Interfere with the operation or security of the Service.
• Use automated systems to abuse, scrape, overload, or disrupt the Service.
• Infringe another person's intellectual property, privacy, publicity, or other rights.
• Use the Service for spam, phishing, fraud, or other abusive activity.

We may remove content, restrict access, suspend accounts, or terminate accounts when we reasonably believe these Terms have been violated or the Service is being abused.

8. Your Content

You retain ownership of content you submit to Agency Card.

By submitting content, you grant Agency Card a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, resize, format, and otherwise process that content as necessary to provide and operate the Service.

This license ends when your content is removed from the Service, except where continued retention is reasonably necessary for backups, legal obligations, fraud prevention, dispute resolution, or security.

You represent that you have the rights necessary to submit and publish any content you provide.

9. Agency Card URLs and Custom Domains

Agency Card may provide users with hosted URLs, usernames, slugs, custom domain functionality, or similar identifiers.

We may refuse, reclaim, change, or remove an identifier that infringes another person's rights, impersonates another person or business, violates these Terms, or creates a security or operational issue.

You are responsible for maintaining any domain name you connect to Agency Card, including registration, renewal, DNS configuration, and compliance with your domain registrar's requirements.

10. Analytics

Agency Card may provide analytics such as page views, link clicks, traffic sources, devices, dates, and other usage information.

Analytics are provided for informational purposes. We do not guarantee that analytics will be complete, perfectly accurate, or identical to measurements from other analytics platforms.

11. Free and Paid Plans

Agency Card may offer free and paid plans with different features, usage limits, and functionality.

Current plan details and pricing are displayed on our website or during checkout.

We may add, remove, or modify features associated with a plan. If a change materially affects a paid subscription, we will provide reasonable notice when required by applicable law.

12. Billing

Paid subscriptions are billed according to the billing period selected at checkout.

Unless otherwise stated at checkout, subscriptions automatically renew until canceled.

You authorize our payment provider to charge the payment method associated with your account for subscription fees and applicable taxes.

You may cancel a paid subscription at any time. Cancellation prevents future renewals but does not automatically entitle you to a refund for amounts already paid, except where required by law or where we expressly state otherwise.

If payment fails, we may limit or suspend access to paid features.

13. Changes to Pricing

We may change subscription pricing from time to time.

Pricing changes for existing paid subscribers will take effect no earlier than the next applicable renewal following any notice required by law.

14. Intellectual Property

Agency Card and its software, design, branding, trademarks, logos, and other materials are owned by Agency Card or its licensors.

Except for the limited right to use the Service under these Terms, no intellectual property rights are transferred to you.

15. Feedback

If you provide ideas, suggestions, or feedback about Agency Card, you permit us to use that feedback without restriction or compensation to you.

16. Availability and Changes to the Service

We may modify, update, suspend, or discontinue portions of the Service.

We do not guarantee uninterrupted or error-free availability.

From time to time, the Service may be unavailable because of maintenance, technical problems, third-party outages, security incidents, or circumstances outside our control.

17. Disclaimer of Warranties

To the fullest extent permitted by law, Agency Card is provided "as is" and "as available."

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that using Agency Card will generate leads, quotes, customers, sales, revenue, or any particular business result.

18. Limitation of Liability

To the fullest extent permitted by law, Agency Card and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, goodwill, or customers arising from your use of the Service.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service will not exceed the greater of $100 or the amount you paid to Agency Card during the 12 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Agency Card and its owners, employees, contractors, and affiliates from claims, damages, liabilities, losses, and expenses arising from your content, your use of the Service, your violation of these Terms, or your violation of another person's rights.

20. Termination

You may stop using Agency Card at any time.

We may suspend or terminate access to the Service if you violate these Terms, create legal or security risk, fail to pay applicable fees, abuse the Service, or use Agency Card in a way that could harm Agency Card, its users, or third parties.

Provisions that by their nature should survive termination will remain in effect.

21. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the effective date and provide additional notice when required by law.

Your continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

22. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law principles.

Any disputes relating to these Terms or the Service will be brought in the state or federal courts located in Jasper County, IA, unless applicable law requires otherwise.
